Seriously. Can anyone explain why this man is not going to prison?

    Luckily the law relies on evidence and the presumption of rehabilitation, otherwise any small misdemeanour would mean the death penalty. Whoever sentenced did so based on the evidence of the case as presented.

    None of this helps the family of the dead woman, although whether or not he got a custodial sentence it would not bring her back. I feel for them, but seeing as the defendent was not driving drunk or dangerously (or he would have been charged with those offences) this is probably about as severe as they can hope for.

    Maybe because his previous conviction has shown that he has total contempt for the law in the UK.

    He has demonstrated that as far as he's concerned, the requirements that most motorists abide by don't apply to him, and I wonder how long it will be before he's back behind the wheel illegally again, something that he wouldn't be able to do if he was behind bars.
    So for every minor misdemeanor, one should expect the breaking of stones on the moors around Princetown?

    I couldn't agree more, but as this person had previously been convicted of a serious driving offence, I would hazard a guess that he wasn't rehabilitated very well.

    Well, it's your option to consider drunk driving as a "minor misdemeanor", but I certainly don't.

    Maybe, maybe not. He wasn't drunk, and we don't know the circumstances around the insurance. Maybe it mostly worked? We just can't tell! :)

    I presume but if you get banned for drink driving for twenty seven months, you were either extremley drunk or it isn't the first time you were caught.........

    Just one observation from this (and I chicken out from giving my views of the rights and wrongs) but a big congrats to the Mercury on giving what looks like to be very balanced report of the case:

    This is opposed to the less well informed reports from the BBC and Guardian which just focused on the sentence.

    Indeed; a much more informative and balanced article. And from what has been reported there the sentence does indeed look more or less spot on.

    I did a quick search in relation to this and found a number of earlier reports with the thought of publishing the links here.

    However, each of the reports had a picture of the poor victim Claire Glaskin and I thought enough is enough. It’s been a long time since the tragic accident but my heart still goes go out to her friends and family.
