Remember, DLA is not awarded due to a medical condition, but rather the care or mobility needs that arise from that condition. The DM will make their decision based upon the most up to date information available to them. They will not always go out for medical evidence, and will only do so if they need something clarifying. Although DM's are not medically trained, they do have an in house medical services at Blackpool and they will sometimes ask them for clarification on medical points.
The best person to give the DM the most up to date information on their care or mobility needs is the customer. It is so important to give a full picture of those needs on the application form (some people keep a diary for a week and submit this). I have known people miss out information on the form in the mistaken belief that the DM will write out to their GP.0 -
When you get your decision, if it is a refusal, they should give you reasons. If they don't, then ask for written reasons straight away. You have one month to challenge the decision. If you ask for reasons, then you get an extra 14 days to challenge.
I have seen a number of replies where the written reasons totally contradict the claimant's evidence in his/her application. So you could ask the DM to look at it again. Even more so if they have not taken into account any doctor's or specialist's report. Asking for a review is usually quicker than going straight to appeal. However, if you do appeal, they have to review the decision first, before going to Tribunal. Many cases are awarded it on review.0
