    I did not agree to the oil payment. Three weeks after we moved in we were just presented with the bill and told we owed him.


    I could present you with a bill telling you you owe me £10k, doesn't mean you have to pay it. By paying it, it appears you did agree to it.

    Would it be possible to remove the oil from the tank and sell it to a neighbour or maybe the next tenant would wish to buy it?

    Would the next tenant also be interested in buying the stove perhaps?

  • I doubt the next tenant will want to buy either the oil or the stove. he is a new employee on the farm. He is in holiday accomodation and has notice to vacate. The flat our LL is 'doing up' for him is not ready so he is coming in the house in the mean time.

    This thread has run its course......I will not be posting any further .

    I do sympathise with the OP over the oil - this is not the first time we've had threads relating to payment for oil. Last time the tenant had just refilled the tank and then given notice (one month, periodic tenancy) due to a change in circumstances. LL refused to 'buy' the oil.

    The trouble is the oil supplier won't buy it back (it could be contaminated so can't be re-sold), it's difficult to sell elsewhere (you need a pump and tank) so options are limited. There were even suggestions that the tenant drain the oil into the garden (criminal damage/environmental pollution) rather than leave it for th LL.

    The ideal solution of course is to have an agreement up front about what will happen regarding this fuel.

    In this case, the tenant has (reshly) agreed to pay for the bill the LL presented at the start, without any agreement about oil at the end. I initially thought the LL was insisting on payment as part of the contract (ie "pay this oil bill or I won't' let you move in"), but the fact that the bill was presented 3 weeks later makes me very surprised that the tenant (OP) agreed. To NOW start saying "It's unfair I was given no choice is rediculous. The choice was to decline to pay, or to evaluate how much of the oil was left and just pay that proportion. AND to get agreement that the LL would refund for any oil left at the end of the tenancy.

    I disagree about the deposit, I have checked on the register and none of the ladlords proerties or in fact he is registered which is obviously why he gets away with things.
    As this property is in Scotland the LL is committing a criminal offence if has not registered himself/the properties. Unless I missed it, the OP had not mentioned this earlier in the thread.

    OP- report his letting activities to the local Council..
