its a long winded story so will make it as short as possible
Basically Welcome took me to court (unknowingly to me)saying i owed them £952, i only found out when someone turned up at my work with expenses forms to fill in and they said i had a county courty judgement on my name. The loan was taken out in 2003 and paid in 2006.
Welcome said i had arrears which i said i didn't. Anyway in return i took them to court to have the county court taken off my name and get the said claim put back to the begining so i can fight the claim.
The judge ruled in my favour, claim went back to beginning and they were ordered to pay me £75 court costs. They never paid to court costs so i informed the court, the court sent them a letter saying if they don't pay me there claim will be struck out. Needless to say they never did so the court sent a court form saying there claim had been struck out. The end or so i thought...
5 months later i get a call from a random company saying there chasing money for Welcome and i owe them £750!! I told them to go away sent them copy of the "struck out form" and all letters and rang them to check the case was now closed and they said they had spoken to welcome and it wasn't closed - struck out just meant they couldn't take me to court anymore or send bailiffs!!
I told them not to contact me again.
In meantime i processed a claim with a 3rd party for missold PPI from welcome on the said loan as i hadn't been aware it was optional (as anyone who had a loan with welcome would know) anyway THEY HAVE admitted MISSELLING me the PPI and offered £1720 but said they will only pay me £520 as i have £1200 of arrears on my account!!!!
So heres the thing, whos right whos wrong.
My friend works in a solicitors and she said once something like this is struck off thats the end of it, no arrears no nothing, she also said that you can't have arrears on a policy that has been missold to me.
The company chasing money for me are just happy to let welcome fob them off, ring back MOnday, ring back Friday blah blah. There latest being we have emailed a PPI solicitor to seek legal advice?!?!? shouldn't they just ring there company solicitor. Have a hard copy with there "offer" on so its admitting missold.
Just want to know approach to get the company to take - not being fobbed any more
Am i correct that i am entitle to FULL amount and i no longer have the "arrears" they claim i have
any help would be good. Meant to be a short email but clearly isn't!!
