Help! Pregnant and just found out about redundancy!

Options
Im really hoping I can get some advice on here.

Im 7 weeks pregnant, and have just found out today that the business is moving to india and as of july I will be unemployed!
Firstly, I have been there for 9 years...do I automatically get statutory redundancy pay?? If so, I have done a calculator and its pretty poor as I was 17 when I started there.

Next thing, we dont know an exact finishing date yet, but told its probs end of july, making me about 28/29/30 weeks pregnant by then. Am I still entitled to SMP as I will have still been employed after the 15th week before my baby is due??

If so, will I have to start SMP when my contract end or can I claim something else in the meantime and THEN start SMP when baby is due??

What are my rights? What am I entitled to? I am so worried, I will stay where I am until July, I get good wages for my hours so the way I see it I may as well stay there as long as possible to get as much money as possible. My head is all over and could do without this stress, Im only 7 weeks pregnant and tryin not to get worked up its very hard.

Also Im married, DH on a fair wage so not entitled to much help with benefits etc and we already have a 4 yr old daughter.

Advice will be greatly appreciated.

  • Hi

My wife was in this exact same situation a couple of years back. She spoke to the administrator dealing with the redundancies. Anyway he informed HRMC and they paid the maternity pay directly to her, took a couple on months to get it sorted. Bearing in mind she was already on maternity leave when she was made redundant it's a long time.

However just to put your mind at rest you're entitled to S.M.P. However just a warning they pay it in blocks of four weeks and if, like my wife, you get another job in that four week period you pay the full amount back.

If your employer cannot pay you SMP because they are insolvent or bankrupt, or the firm is in liquidation, phone the HM Revenue & Customs Statutory Payments Disputes Team on 0191 2255221. HM Revenue & Customs will need to know:
    • your name and address
    • the date your employer became insolvent
    • details from your payslips of any payments received and the period covered by the last payment
    • the date the Statutory Maternity Payment ends or the date you intend to go back to work
You may also be asked to provide some of this information in writing.
Arrangements can then be made for you to be paid.
But note that HM Revenue & Customs can only pay you from the week of your employer’s insolvency. Any SMP you are due for earlier weeks remains the responsibility of your employer.
If your employer is not insolvent or bankrupt, but is in financial difficulties or the business is closed, they should still pay you SMP. Make sure you give your employer notice and medical evidence at the right times. If you have any difficulty in getting payment from your employer, phone the HM Revenue & Customs Statutory Payments Disputes Team on 0191 225 5221.
