    Yet he still lives at his Dads at least 6 nights a fortnight, pays rent, eats there, does washing there and contributes to all bills! If has no personal effects at my sisters except a toothbrush, he brings a bag with him.
    She does not want to live with him permanently as they have only been together 9 months. If she were to lose her discount, I assume his Father could then claim a discount, yet all his post, his rent etc would still be payable to his father as he does live there!

    Think the best way forward is to contact the town hall and seek advice.

    There really is nothing to address here which beggars the question why are you dabbling in your sisters life, is it that you do not like the boyfriend?

    I think there is something to address, seeing how everybody seems to have a different opinion. And I'm not 'dabbling' in my sisters life, she asked for some advice and being a decent brother I said I would look into it for her. I like her boyfriend, he's a decent guy, what that's got to do with anything I don't know!

    I deal with sole or main residence determinations on a regular basis. The time spent can be a factor used but it isn't the only factor used - case law has already ruled on that fact.

    Surely you should know that claiming a single person entitlement where one is not entitled to it is classed and prosecuted as a benefit fraud?

    Where that entitlement (single person) is falsely claimed, it is considered and prosecuted as a benefit fraud.

    Yes we are talking CTB in this scenario although a genuine claim for single person discount is an entitlement not a benefit.

    You have asked specifically of your sisters circumstances, not in general circumstances.

    Why not google 'council tax single person benefit fraud' and no doubt see many situations like your sis.
  • I have just called the town hall myself and asked for any general information that they could give me. From the information I gave they said she would still be entitled to a discount, as the way things are at the moment, his Dad isn't entitled to the discount as he rents a room in his house. They recommended that she writes all this down and sends it to them for official confirmation.

    My sister was in a very similar situation to yours OP and she e-mailed the local council for clarification and was told she was entitled to her discount as he was paying at another residence. Her situation was practically identical to yours. Do still send them all the details though to cover yourself.
