what to do next !

hi im kim,i have borderline personality disorder and dependancy disorder.I have been on esa for over a year now, and have recently been to a appeal for my medical that i had last year,which was rejected.when i went to the appeal the judge there was nice but the doctor tried to make me out to be lying,she explained it was my mental health from last year that it was based on,she said that as my illness has deteriorated over the year that maybe i returnto my gp for more help again.My appeal was rejected based on my health last year, i am on esa,have a certificate till the end of this month,i have tried contacting the c.a.b. but they havent got back to me yet.i was wondering if anyone could help me,i am very depressed,my health ,mentally is worse, and i have hardly no help from my gp ,etc,i am recieving child benefit for my sons,and child tax credit,but i was wondering about re applying for esa ,or what i should do...it has been such a hard time for me, and continually cry,have to be alone, sometimes unable to go out my room.if anyone could give me any ideas will be much appreciated thanks

    You can reapply for ESA, but you are unlikely to receive payment until you have had another medical. How old are your children, and do you have a partner?

  • my sons are 11 and 18, my 18 year old is in further education, i am a single parent,

    If your children were younger you would have been able to claim IS, but that would not be relevant now.

    When you have to complete the ESA50 form make sure you get help with it, and the same with the appeal. One of the main reasons that people can slip up at the appeal is by focusing on their current condition, as opposed to their health at the time of the decision.

    Are you receiving LHA and CTB?

  • i am at present getting esa, well i was,my appeal was monday 14th feb,and it was rejected, and yes i did emphasise on my illness now,as to last year,i am getting housing benefit and child tax credit,but my certificate runs out on the 28th opf this month, thank u for ur advice much appreciated

    Your ESA will have stopped on the 14th. You need to get a new certificate and make a new application straightaway. Also notify your local authority that, although your ESA has stopped you still wish to continue your LHA/ HB claim.

    There is always the option to appeal the Tribunal decision again, however this would need to be on a point of law as opposed to a disagreement on fact. From what you have said, it is unlikely that a further appeal would be granted.
