Personal Injury

Hello

I was wondering if anyone could help me?

A couple of weeks ago i was walking home from work and went to cross at the Zebra Crossing.

When i got about 3/4 of the way across the car coming from my left failed to spot me. He hit me at about 15/20 mph. The police and ambulance were both called and off i went to hospital complaining of leg pain and the police have charged him with driving without due care and attention.

Luckily nothing was broken, just severe bruising and soft tissue damage to both legs.

I have put in a personal injury claim, basically to claim back the damaged items ( engagement ring, clothes etc, ) , i just wanted to know what happens now as this is all new to me.

I have today received a letter from the UK Independent Medical, is that for them to check out my injuries etc?

    Yes; in order to issue a personal injury claim you need a medical report detailing your injuries, and before a medical report can be written the medical expert needs to examine you.

    Once the medical report is in hand and the prognosis for your injuries has been established, your solicitors will then approach the other side (which realistically will be the driver's insurance company) and the matter will go on from there. If liability is admitted (it does seem like a straightforward case, so hopefully it will be) it will just be a matter of the two sides agreeing an appropriate settlement figure. If the liability is disputed or a figure cannot be agreed upon, your solicitors will issue the claim and it will proceed through the court system.

    Either way it is something of a waiting game from your perspective. You will have to attend this examination, and then no doubt the report will be sent to you to check, and you may be interviewed for the purposes of a witness statement in due course, but by and large your solicitors will be handling the day to day running of the case and you should have relatively little to do.

    Take detailed photos of the damaged items - clothes and ring - as evidence. With the ring, get some quotes from good jewlers for its repairs and submit these as part of the claim.

    For the clothes, unless you can prove they are brand new, you are unlikley to get the cost of their full value.
  • Thanks for your replies both of you. I have spoken to the solicitor this morning, i think it may be quite straightforward, the other side has admitted liability and have offered a pre-medical examination offer, which i think is too low, but the solicitor has said they normally offer a small amount before the medical anyway.
