Distress and Inconvenience.

Hi,
I have noticed on another forum about bank charges that they have suggested claiming an extra amount for Distress & Inconvenience. Do you know of anyone who has succesfully done this? I hve many unpaid bills that I am struggling to pay due to my charges and I am also now signed off work due to depression (finances being a major contribution). I am on a DMP and I am just starting to add up my bank charges and so far they are over £2000.

I know that a lot of people would like to claim for this but the stress involved would probably not be worth it. I'm sure it would involve doctors, financial reports etc etc do you think you could stand it ? it might just be best to get back what you are owed and try and move on. I really don't want to stop you or belittle your distress I certainly know about that. I just would not want you to tread on unfamiliar grounds and make yourself ill again.

if you could prove in court that the banks charges are resplinibly for stress/anxiety, i guarantee that these charges would stop0

Problem is the onus of proof is on you. It's not as straightforward as claiming bank charges back. Each case would be different and would require as Lizzy says visits to the doctors, specialists.
I'm not saying you may not win, but it's not 'easy money', as likely you would need to involve a legal professional on your behalf.0 -

I certainly appreciate the issue and would back anyone with such a claim, but in reality (i.e. from experience) the banks are simply not bothered - either by claims for refunds or by any additional parts to a claim.
They are effectively behaving as though they are a law unto themselves.
I don't like being a party-pooper by the way, this is just how I see it.0
