Black Horse HP/Finance claim

I bought a motor caravan on hp with ppi from a dealer in 2007. My agreement is still running (finishes in 2012) I complained to Black Horse using a template letter, they have responded saying as they did not sell me the ppi policy the dealer did, so they dont consider themselves responsible. They have said they have forward a copy of my letter to the dealer, "asked them to investigate my concerns" and to respond directly to me? Furthermore they consider their letter to me to be "our final response" and if i am not satisfied I should take it up with the FOS.
If i understand the information on the MSE PPI reclaim correctly Black Horse are ultimatley responsible for the actions/ommission of their agent? :o Would you please advise my next step?

    That is correct.
    Whoever sold you and set up the account is the ones responsible.

    I would just to be on the safe side write to the dealer and make them aware that you understand your complaint have been sent to them by the lender.

  • If the dealer was authorised by the FSA to sell insurance products, then they are ultimatley responsible for the sale.
    We've spent decades teaching people about their rights, but nothing about their responsibilities.

    Update as of today 21.2.2011
    i recieved a letter from the dealer, saying they do not accept that their salesman pressurised me into buying the ppi, also they say they only sold a handful of ppi agreements and were only sold by request of the customer and black horse should be able to confirm this fact, furthermore they say i would have sign a "demands and needs statement" Apparently i would have been asked a series of questions about my circumstances and i would have signed this form with a copy being kept by the dealer.
    I do not remember being asked such questions or indeed signing a form of this nature, i have searched all my paperwork regarding the sale and i cant find any such form.
    they say that because of a fire at their premises in 2009 all records have been destroyed in the fire otherwise they would have sent me a copy.

    What do i do now

    Hi there

    I would contact the Information Commissioners Office (ICO) for advice on this, maybe the data will be kept somewhere on microfiche, see what they have to say.

    And how would they remember all the details they given you?
    They must have something to go by to have given those reasons of not accepting liability.

    I left word with those gov'mnt bods with no reply.
    so im going to send a second letter to the agent who sold me the ppi asking for them to look into my case again and if they dont respond with a favourable reply within 14 days i will go to the ombudsman.

    I think they have backlogs of emails to be honest, but did you also try to ring them?

    i sent my second letter
    the company sent me another knock back letter
    so i phone the ombudsman earlier today, the chap on the phone said they will take up my case.
    The ombudsman is going to send me some forms
    so if you have any tips i would appreciate it:)
