Hubby has been in his job over 2 years. He works as a cook doing night shift.
He got a warning (stage 1) for absence due to sickness, has IBS - he gave the employer a letter from the doctor saying he has IBS. They said that is no excuse - but I feel that is bad as you can't work with food if you are sick or have diarrea. He has never had his food hygine cert done - which I think should of happened but they keep fobbing him off.
He got a stage 2 warning at the beginning of the year for more absences - he appealed it but it was still held. The absences were because my grandmother died and we had a small car accident driving in to work and didn't get pulled out of ditch till early hours of morning.
He is now been called to a disapplenary hearing for a stage 3 as he didn't turn up for work last week. But the thing is - he usually works night shift and about 5pm last wednesday one of the other cooks calls asking where he was - he was meant to do day shift. Firstly he always does night shift, he has never been trained on day shift ways and why was it a cook calling and not a manager.
Stage 3 I think can result in dismissal but I feel they have been totally unfair, but how can we presude them not to get rid of him.
WHen he had the stage 2 hearing the manager laughed saying everyone has car accidents and still can get to work. It was 2.30am before we got home from it and there were no buses - they weren't going to pay for a taxi and they had the cheek to ask can your wife not drive you in, even tho she was sleeping and had work the next day herself, and trying to calm down after the accident (no harm done to car just stuck in a ditch because of ice).
I am so worried as we need his job - his income helps out so much, he has been trying for else where but nothing as yet. I just wonder do they have in for him - he is a foreigner - but has all the legit papers to liveand work here.

That's ridiculous, they seem to have something against him and they're going through the motions so they don't get done for unfair dismissal. Hope he manages to get through it and keep his job, or even better, find somewhere that actually deserves him.

that's aweful! to have a car accident and be told off for not turning up! then to change shifts and not tell him!
it only speaks of his dilligence that he hasn't walked out yet! so they should want to keep him as he's obviously loyal and conscientous even after being treated like that.
