Car Insurance query

My daughter is 20 and has her own car, which is insured in her name with her father as a named driver. There is a £1000 excess on the policy. Just before Christmas her Dad was at traffic lights (in her car) and as they were all pulling away the car in front slammed on and he went into the back of it - I was with him and he wasn't going more than about 5 miles an hour and there was absolutely no damage to either vehicle. The car was a mini-cab and the driver said that it was okay and they swapped phone numbers. Last week we were notified by my daughter's insurance company that the driver and his passenger had put in claims for whiplash and damage to the vehicle. This is utter nonsense - the passenger was non-existant and there was absolutely no damage. The insurance company said that they will refer it to their loss adjusters but said that it will probably be settled. As there was no damage to my daughter's car is the £1000 policy excess still payable on the third party claim? Also, her father has his own car which is insured in his name so could he process the claim through that insurance policy as he has coverage to drive any other vehicle with the driver's permission?

    As he is a named driver on the responsible car's policy, then his driving other cars cover won't pay out.

    But there is no excess to pay anyway.
