Claiming in Scotland/ Time lapse LBA & action

Hi all,
Would someone clarify the procedure in Scotland? I read that moneyclaim is used in England and Wales and the Sherriff court here in Scotland.
I would really appreciate some help with this.
I started the ball rolling in April- up to the stage of LBA letter to halifax- I was offered half of my request. It is now November and I am concerned that I have let too much time lapse between LBA and claiming. The offer letter from Halifax did say that if I did not reply within 8 weeks they would ASSUME I was happy.
The timelapse occured due to some shifting priorities in my life and I lost focus. I am back into my MS in a big way now, lol.
I did start with the Clydesdale too - they did not offer at all.
Has anyone else any dealings with them?

Hi there i did the same with BOS and i left it 4 months before raising my small claim my court date is 18th December and i have had nothing back so far. The point is the banks are very unlikely to defend so i would just go ahead and raise the claim its Form 1A & 1B that you need to complete you will find it here - http://www.scotcourts.gov.uk/sheriff/small_claims/forms.asp
remember in Scotland you can only claim up to £750 excluding interest in one go so you might have to split your charges if they are above this0
