Cardiff Council

My Husband received a parking fine thought the post for 70 pounds from Cardiff council. I have NO problem paying fines that we are responsible for, but they have the wrong color car down on the form my husband car color is light Green and they have Grey down but they say the color is irrelevant at the time my husband was picking me up from somewhere else at the time, My husband has spoken to our local police who have told us to appeal and to phone the council and ask for photographic evidence. I think it will end up we Will have to pay :mad: Problem being we are worried someone is using my husbands registration number and things could be more serious next time any advice please :beer:.

    The council's civil enforcement officer should have several colour photos of the offending vehicle, including one of the tax disc.

    There will be any number of clues even if the number plate is the same, your plates may be a slightly different typeface, or have a different maker/dealer name.

    The photos should enable you to establish beyond doubt if it was your car or not.

    Presuming it is not your car, your appeal will be allowed.

    Are you certain the other car is the clone and not yours?

    How long have you had it? Did you buy it brand new?

    I don't see there is much you can do about the other car and the offences its driver might commit in future, other than informing the police now of your findings.

    At least you should have photos to demonstrate there is another car with your reg number.

  • Its not unknown for ceo's to get the reg wrong, eg---C instead of G so wait for the pics. If the ceo did not take pics can you prove elsewhere? Expect the council to refuse the informal challenge and send you an NTO. If so take copies of both sides, remove identifying bits and post on pepipoo.com.
    I see you got it by post, was it a "so called drive away" or was it a CCTV one in which case you could already be at the NTO stage. Look at the real pics and see if you can see different features on the other car to yours.

    Thank you Peter-the-piper I think it was" drive away" we can prove elsewhere by my sister but would they take family evidence ?we have only just sent letter to ask for the photographic evidence.

    Why would you 'have' to say it was a family member? Different surname?

    If this wasn't your car then certainly appeal (in fact I would always appeal a Council PCN even when it was my car...) but I would also post on pepipoo forums if I were you:

    There's a danger you could be pursued for this further - Councils don't always give up easily - and you need to know the procedure if the Council decline your appeal.

    What have you actually received? A Notice to Owner? Post a pic of all pages along with your new topic on pepipoo, they will need to see the paperwork to help you (blank out address/car and PCN number ID but not dates).

    have you (your husband) already made an informal challenge in writing (letter, email, on-line) or are we talking just 'phone calls' so far?

    If you are still within the 14 day period from initial receipt of the PCN & have not made an informal challenge in writing, then do so asap.
    Even if your husband has already made the challenge, there is nothing to prevent him making another one if he is still 'in time'.Make it clear that the challenge is made on the basis that the alleged contravention did not occur insofar as your husband and his vehicle are concerned, (giving reasons). Request photos.

    If the informal challenge is rejected or you are now 'out of time', the Council will issue an NTO (Notice To Owner). This can be further formally challenged on the same grounds.

    I also second the earlier advice to post on pepipoo.

    Re the 'cloning' issue, let's wait & see what the Council evidence is first (photos). It may all be a mistake on their part.

    True, although it's some coincidence the mistaken reg number has shown up the same make and model of car in a similar colour.

    I was concerned the OP's car might turn out to be cloned/stolen, putting it at risk of confiscation.

    Happily for the her, she bought the car new, which means it must be straight.

    I used the word 'mistake' quite deliberately in the widest possible context of its meaning. Like I said, let's wait & see what develops......
