Advice Please Chased for incorrect Debt EDF / EOS Solutions

Help please anyone.
I am being chased by EOS Solutions for a debt sold to them by EDF Energy for Gas using during the period of Sept 2002 to Sept 2007.
Apart from the fact I changed suppliers in 2005 and I can prove monthly direct debits from before that point. I've never received any notification before a letter from EOS in December 2010.
Anyone help with my rights EOS are now threatening legal action.
Am I within my rights to tell them to stick it I’ll see them in court, what happens when a debt is sold\mis-sold in this case?

  • Whilst is galls to spend time on something you know isn't your fault, I would contact them and find out the dates/amounts that they say are owed.

    Then go through it and show they are not due - eg, more than 6 years old or you were not with the supplier then or payments made on x dates.

    It will save time in the end.

    Would you believe it’s for the whole period apparently £1500!
    One of my arguments with them is surely they'd have cut me off or bothered to send me a letter before now. I need to know what my rights are, do I continue to contact EOS or do I should I contact EDF as the debt has been sold to EOS.

    No but its my problem to sort it out.
    Whats to stop anyone making up a debt and selling to a 3rd party collection service!

    shipy, you contact EOS Solutions and tell them the debt is in dispute and they must stop chasing you for it. Legally, they should cease contact with you and return the debt to the originating company. You contact EDF Energy and get clarification of when and what the debt relates to. If you owe the money, suggest you pay them. If not, let's hope you can prove it. Good luck.
