    Why did father in law make the transfer?

    That is the question you need to be able to answer, without of course saying to avoid nursing home fees. Maybe it was so father in law wouldn't have to be responsible for ongoing maintenance, because he was considering a second marriage and wanted to ensure the children of his first wife were protected and make sure the potential second wife was not a money grabbing so and so... If there is a reason why the transfer was made, then it will be very hard to prove deliberate deprivation, esp as the transfer was so long ago.

    Daughters may wish to pay a top up fee to move him to a nicer home than will otherwise be provided, though.
