Thanks di that reply and a good nights sleep made me think waiting would be better.
I am just very wary of having the complaint started via the telephone and not in writing. But the SAR should be on it's way soon too.DFD: 23/12/20100 -
Yes I know what you mean, its is more beneficial to do a complaint in writing other than on the phone, but if its only 5 working days they said, at least if you don't hear by then you still have the opportunity to continue to make a reclaim in writing as well.
What I was going to post up was.......
You could still write to them, and make them aware you made a telephone call on date XX/XX/XXXX in regards of a reclaim on the PPI, and you were informed you would hear something by 5 working days, if you want to just enclose a letter of reclaim in your own words at the same time, you are then killing 2 birds with one stone, or optionally complete the reclaiming questionnaire, either one.;)
Tell them despite the telephone call you have enclosed a copy of your complaint.
You are covering your ground then if you know what I mean.

I received the letter I was promised (but not the one I wanted). The letter basically stated that they weren't prepared to make a decision on my case because of the judicial review. I am taking this as a sign that they are unwilling to even bother looking into it for a while yet and want to gain as much time as possible by using the review as an excuse.
So as the complaint was made over the phone do you think I should send them another letter saying that I want them to look into it regardless of the review along with my questionnaire? Or just go straight to the FOS?
Will I gain a decision from the FOS? Or will they just push HFC to look into it themselves? Will this be within 8 weeks or will it be longer because of the review?

Hiya
You can take your complaint to the FOS if you want to, however it may be the same for them as well at this time, and they do have very large volumes of these complaints.
With 2 of mine they are still sitting with the bank and have been since before Xmas, and this is because of the JR matter, but I did hear there may be a decision over the Easter period hopefully.
But you should have a choice here now, either wait or go to the FOS, with mine I'm going to see what happens over Easter and if nothing by then I will move on to the FOS, but this is discreetly your decision only now.;)
