Is this allowed?

I had car insurance with Elephant.co.uk and I was paying £117 a month for insurance on a Mercedes E320. The car was my boyfriends but I drove it and had full comprehensive insurance.

In December, while the car was parked outside my house, it was hit by a third party and the car was declared a write off. I was not in the car at the time.

I had a nightmare of a time with Elephant, telling me different things all the time but the worse news was when I got the settment cheque.

They had deducted £500 from the cheque because I had 4 months left before my insurance needed renewing!!! Is this allowed?? I mean the accident was not my fault, the third pary admitted full liability, the third parties insurance paid all of the costs so why did Elephant keep £500???

Please advice if I can do anything to reclaim this money

    Your insurance is a annual policy not monthly the fact that they allowed you to pay monthly is a concession, as the claim was settled the remainder of the full annual amount became payable, so yes it is allowed and is normal.

    the mistake you made was claiming off your own insurance, you should have gone direct to the TP insurance and your own insurance would have continued as normal.

    If they have just collected the rest of the premium then there is nothing you can do, if they have collected the rest of the premium AND ended your policy then the lost £500 is an uninsured loss which you can recover off the TP insurance company together with your excess and any other out of pocket expenses you incurred
