Item delivered to wrong address...who's responsible for claiming?

I just bought something from a 3rd party seller on Amazon.

The package was sent with Royal Mail Recorded Delivery.

However, I have not received it! I have the tracking number and looking at the Royal Mail tracking website the package was signed for at the local delivery office but not with my signature. Nor did I go to the delivery office on the day of the signature.

"Good thing" is that the item was worth less than the £40 claim limit (but not much).

My question is:

Who is responsible for claiming from Royal Mail? Is is the sender or the receiver?

    The sender forms the contract with Royal Mail to deliver the item so the sender has to make the claim.

    this is a worrying trend, we hear more and more about parcels signed for but not delivered

    I agree. In that instance if item has bene technically 'delivered' the seller can win an Amazon A-Z claim (and on ebay would win a paypal claim) and buyer has nothing to claim for from Royal Mail as item is not lost.

    Tricky one and another reason why I am reluctant to ever use recorded delivery.
