Faulty blackberry from o2

Hi
i purchased a balckberry under contract last august, i complained to o2 in jan (within 6 months) that it kept freezing and i couldnt make calls etc, i was told there are different rules under contract, and that i only have 28 days to return it, even with a fault, not the 6 months as the sales of goods act states.
I have never heard of the sales of goods act excluding contracts, has anyone else???
I need advice please

    I think you've misunderstood. Within 28days they'll let you swap for a new one. After 28days they'll offer a repair. Its consistent with the sale of goods act.

    no i am aware of the standard 28 days, O2 addditionally claimed contracts dont have the same rights as other consumers, i,e that they need to be fit for sale for at least 6 months and if they fail within 6 months the shop has to proof that it was the customer at fault

    That's very strange that they told you that.

    My BB stopped working after 3-4 months, they just took the handset back and sent me another, did the same when my Nokia went wrong after 9 months.

    I would try calling them again in the hope that you'll get someone who knows what they are talking about.

    What are you actually asking them to do? have they not offered to fix or at least attempt to fix the phone?

    They are allowed to try to fix it. But (and I think this is the case with RIM as well as HTC) it may be quicker to go straight to the manufacturer - For instance CPW took over a fortnight to slowly shuffle my HTC handset through their processes (and their process is simply to send all HTC phones to HTC, and not repair in-house). I called HTC directly about another handset earlier this week - had a courier collect it the same day to go straight back to their fixit labs. Saved at least a fortnight by ignoring the vendor and their poncing around and going straight to the manufacturer. It may be easier for you to do the same with RIM?
