You have the choice of whether to use it or not. You chose to use it.

I am suprised they did not waive the fee as a 1st offence, i am with Santander and Nationwide and they have both done this for me on seperate occasions, it's just common sense and good customer service. Just take it forward as a forma complaint and also make sure you put this forward as a financial hardship complaint as this maybe considered slightly differently than a normal fees complaint. good luck!
