So you get 25 days AL plus 8 BHs. You're very lucky.

Many people only get the statutory 20 + 8.

I used to get 30 + 8 which was an absolute luxury. Now I'm self-employed I rarely take a day off!

Either way, it's absolutely fine, it's absolutely legal, and you're in a far better position than many.

It is certainly a better situation than my previous job, where by we were left with 17 days after the deductions we had to make.

Would anybody know how I work out what holiday I should have available, with me starting work part way through the year? Using the businesslink calculator it says 6.8 days. Do I just remove 3 days from this? Or the 8 bank holidays?

What date did you start? And does your holiday entitlement run from January to December?

1st jan - 31st dec. Started 4th Oct 2010. The calculator states 6.8 days to take. So do you think I need to subtract any days from this?

Your entitlement is 6.6 weeks per annum. You have completed 3 months service (minus 4 days) entitlement would therefore by 3/12ths of 6.6 weeks = 1.65 weeks or 8.25 days

    Thank you for this.

So would I have to subtract the 8 bank holidays from this? Leaving .25 days?

If you always have BHs off at your workplace (as many office jobs do), then you can just pro rata your 25 days AL, and exclude the BHs (as you're off anyway). In this case, you get the two BHs in December, and 6 days AL (25 days annual leave divided by 365, multiplied by 89 days employed)

If you are rostered onto certain days, including BHs, then it's easier to pro rata the whole lot together. In this case, 8 days which includes the BHs. (33 days total leave divided by 365, multiplied by 89 days employed)

Either way, for last year it works out the same for you - you should have 8 days off in total, two of those are to cover the BHs in December (whether taken on the day or in lieu) and 6 are your AL days. (As Mudd said, I just calculated it slightly differently!)

Re your last question, no, don't take the 8 days off. The 8 days are over the whole year, not three months! You take two days off, using either calculation.

You can either see your leave as 25 + 8 (which is easier if you always have BHs off).
Or you can see your leave as a total of 33 (which is far easier if you are rostered to work on BHs).

' <-- See that? It's called an apostrophe. It does not mean "hey, look out, here comes an S".
  • Thank you all for your help and advice.

I think I have my head around it now.

I've just started work at a company in UK and there are saying we get 25 days holiday per year (1st Jan-31st Dec).

I showed the directgov holiday website to my manager and she in tuen showed it to the department head.
He said that the Bank Holidays are included in the 25 days, that in fact the company give us 33 days holiday, less the 8 bank holidays leaving us with 25 days.

    Can this be correct?

If you're bieng paid 25 days holiday and they pay you for bank holidays then you're getting 5 days more than the minimum.

any holidays you didnt take last year(4th october till 31st december) could be lost, as your employer doesnt have to carry them over and they cant pay you for them. therefore you have only accrued holidays since the 1st january.
