25 days holiday entitlement?

I've just started work at a company in UK and there are saying we get 25 days holiday per year (1st Jan-31st Dec).

I showed the directgov holiday website to my manager and she in tuen showed it to the department head.
He said that the Bank Holidays are included in the 25 days, that in fact the company give us 33 days holiday, less the 8 bank holidays leaving us with 25 days.

Can this be correct?

The last place I worked gave us the full 28 days less the bank holidays, leaving us with 20 days.

Any advice?

  • You're not very clear, do you get 25 days plus the bank holidays off, if so that is correct.

    If you work 5 days a week and you only get 25 days INCLUDING bnk holidays then this is short of the legal minimum.

    The 28 day holiday entitlement is often thought of as four weeks (5 day weeks) PLUS the eight bank holidays. However it doesn't have to be like this, after all many employers need all their employees in on bank holidays as this is when they are busy. Obviously they have to take their holiday at other times.

    The legal requirement is that you get at least 28 days in total.

    If your employer gives more (and many do) they can lay down more or less what conditions they like in respect of the EXTRA days but they cannot take away your right to the basic 28 days statutory holiday.

    We get 25 days holiday. We get the bank holidays off work also. A total of 33 days.
    The manager said the company gives us 33 days (although only 25 days were mentioned in the confirmation letter), less the 8 banks holidays, giving us a total of 25 days to take off during the year as our own time.

    I understand the fact that they can give more, but don't understand why they only include 3 of the bank holidays out of the stat. 28 days. Why not give us 36 days holiday leaving us with the 28.

    I was wondering if anyone else has had a similar experience?

    I think you are getting confused.

    The MINIMUM amount of holidays you are entitled to is 20 DAYS + 8 BANK HOLIDAYS = a total of 28 days

    You are being given 25 DAYS + 8 BANK HOLIDAYS = 33 Days

    So you are getting an extra 5 days holiday above the standard entitlement. They are not taking three bank holiday days out of your entitlement; they are giving you these 8 bank holidays in addition to your 25 days.

    Why would they give you 36 days holiday?
    The minimum they have to give you is 28 days, from your post you are getting 33 days holiday so your employer is already giving you above and beyond what they legally have to.

    As I read it the 28 days does not, by law, include the bank holidays. However, they can be included if the employer says so.

    • you are entitled to a minimum of 5.6 weeks paid annual leave (28 days for someone working five days a week)
    • part-time workers are entitled to the same level of holiday pro rata (so 5.6 times your usual working week, eg 22.4 days for someone working four days a week)
    • you start building up holiday as soon as you start work
    • your employer can control when you take your holiday
    • you get paid your normal pay for your holiday
    • when you finish a job, you get paid for any holiday you have not taken
    • bank and public holidays can be included in your minimum entitlement

    I don't think Dolly really means that they have to include bank holidays, it's just the way the numbers work out.
    In theory the 28 days comes from 4 weeks holiday plus 8 bank holidays, but in legal terms, this works out as you being entitled to 5.6 weeks holiday of your standard working week. This can include bank holidays but does not have to.
    Providing you get a minimum of 5.6 weeks holiday, how this is given is irrelevant.

    So you get 25 days AL plus 8 BHs. You're very lucky.

    Many people only get the statutory 20 + 8.

    I used to get 30 + 8 which was an absolute luxury. Now I'm self-employed I rarely take a day off!


    Either way, it's absolutely fine, it's absolutely legal, and you're in a far better position than many.
