    OK....first, that first letter says it details how the amount is made up overleaf. Read that - do you agree with it? If so, then great - make an offer based on what you can afford to pay. They won't review your credit file - they're making claims about things they simply don't have access to do.

    If you can afford to pay the full amount, I'd personally get in touch with O2 and ask them how much you currently have outstanding, then pay them direct, purely because I'd rather the DCA not get their commission.

    There's a good chance the latest letter was sent before they read your letter, so I'd ignore that and wait for their next move.

    Letter from Lowell Portfolio dated 25 Feb 2011 (Recieved it today)

  • Hi there, I find my self in a similar situation I have recieved a letter to day reading

    Dear (my name)
    Your account is still outstanding
    Since our last letter (which I have never recieved this is the first one) we have still not recieved payment in full or been able to set up a repayment plan

    Unless we hear from you about repayment within seven days of the date of this letter, we will obtain a copy of your credit file and review it so that we can gain a better understanding of your finances.

    Your credit file will help us understand:
    1. What assets you have.
    2. Other financial commitments, such as credit cards and other borrowing .
    3. Your ability to repay.

    Based on this information we could then instruct Hamptons legal, our legal division, to use the court system to recover money owed.

    We would obviously prefer to speak to you directly and not have the need to use litigatiom. If you call us, together we can find a repayment plan that suits you. You can set up a direct debit on line.

    However I left Three Mobile at least 5 years ago and believed my account to be settled and cleared as I am now with T mobile and have been for about 4/5 years.

  • Hey, I just recieved the same exact letter from o2 precollections team and Lowell portfolio but strange because I have never had any accounts with O2 whatsoever. and thhey want 1600.00 from me!! should I use the same template? thanks in advance...

    You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.

    We would point out that we have no knowledge of any such debt being owed to The Loan Company.

    We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.

    We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

  • My OH has recently had a problem with Lowell...he's asked them to send a detailed invoice from T-Mobile three times, but all they keep sending is the front page of the T-Mobile bill (Detailing OH old address + amount) plus 5 sheets of t-mobile paper which is blank and supposed to be, I presume, the breakdown of the bill/itemised bit.

    This has been going on nearly a year now with red & lowell and they have sent yet another blank t-mobile bill...any ideas how we progress with this one? We just seem to be going round in circles!
