Please help me! - Red debt collection services

My friend receive a following letter from Telefonica O2 UK Ltd dated 24 Dec 2010 on 05 Jan 2011.

Following a review of our internal system. It would appear that a balance of £140.00 remains outstanding. The balance owing is in relation to an account you held with O2 which was disconnected on 22/04/2008 a summary of how the balance is made up is shown overleaf. It is possible that you may not have been contacted regarding this outstanding balance for some time. This may be as a result of previously failed attempts to contact you since the disconnection date or down to us recently locating you at a different address that that held at the point your account was disconnected.

We respectfully ask that you treat this matter with the utmost urgency. Failure to respond within 20 days of the date of the notice will result in our chosen specialist debt purchasing partner, Lowell Portfolio I Ltd, directly contacting you to arrange repayment of the outstanding balance.

If you have a query regarding this account please call 0844 844 4736 between the hours of 9:00am and 5:30pm Monday to Friday, where a member of the O2 pre collection team at Lowell will be happy to discuss your query. It may not be possible to resolve the query immediately as further investigation may be required, however you will be notified at the time of your call the timescales involved, your account will be frozen and no further action will be taken until the investigations have been concluded.

Alternatively if you would like to arrange repayment directly with Lowell Portfolio I Ltd then please contact them on 0113 308 6018. One of their experienced customer service agent will be only too happy to help you settle your account via one of their many repayment options suited to your individual financial circumstances.

Then she receive a letter on 05/02/11 dated 31/01/11 from Red Debt Collection Service.

We are Red Debt Collection Services and Lowell Portfolio I Ltd asked us to collect the money you owe them on their behalf, you should contact us if you wish to discuss your account. Our aim is to help you bring your account up to date. If you do not pay your debt it may affect your credit rating. We can help you by offering a repayment solution that suits your current budget.

There are a number of ways which you can pay and get your finances back on track. So you must now pay us £140.00 in full or set up a payment plan to suit your current financial situation.

First of all she don't think that she owe that much and second thing that she is not sure what to write them to pay via cheque in instalments. Please help me that i can guide her to resolve this debt. She is a single mum and struggling in life already.

    We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.

    We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

    Contact us within 7 days or risk legal action.

    Since our last letter we have not received payment in full or been able to set up a repayment plan.

    Unless we hear from you about repayment within seven days of the date of this letter, we will obtain a copy of your credit file and review it so that we can gain a better understanding of your finances.

    Your credit file will help us understand:

    1. What assets you have.
    2. Other financial commitments, such as credit cards and other borrowing.
    3. Your ability to repy.

    Based on this information we could then instruct Hamptons Legal, our legal division, to use the court system to recover money owed.

    We would obviously prefer to you directly and not have the need to use litigation. If you call us, together we can find a repayment plan that suits you.
