    As the property is jointly owned, how does the OPs niece pay the rent when she appears to need to do this via benefits and she won't be entitled to LHA as she's an owner occupier?

    Childminding? Part-time work?

    Perhaps if she can stay in her house she will have more opportunities to explore and be more motivated?

    Conversely, I'm exploring risks.

    If the OPs niece is made redundant, gets sick or fails to secure enough income from child minding, then how will she pay the rent?

    Answer is that the OP won't receive any rent from her, just her niece saying its not her fault she can't get housing benefit but can she just put it on the existing IOU rather than making her child homeless by asking her to leave.
