                    I bought a pram in the January sales and paid half price, it was delivered on the 7th of January. I was using it today when I found that the brake on one side has stopped working all together and the other one works most of the time but has failed, I rang boots to sort out a replacement but they said coz it was the 2010 model all the can do is give me a refund and some money as a good will gesture but if I want a replacement it would cost £110 as the replacement will be the 2011 model and the £110 is the difference in the price of the new one after a refund and GWG.
What rights do I have as in think it is unfair to pay £110 for the same model pram.
All help would be appreciated

            You dont have any rights at all, Im afraid, they could have just taken the pram back for a repair and then you could have been without it for weeks but obviously they chose to give you a refund plus.
 All you can do is accept the refund and shop around for another pushchair.
 And it isnt the same model pram, its an upgraded 2011 pram.
 Apart from anything else, why would you want another pram that could be as bad as the first one and might just break again in a few months.make the most of it, we are only here for the weekend.

            Basically you can request a repair/replacement/refund but the retailer can refuse if what you request is disproportionately costly.
 Basically they have a obligation to either put you back in the same position you were in before entering a contract or as if the contract had been completed. Providing a refund (which can be partial to take into account use you have had of the item) fufills this i believe.
 Since the model is no longer in stock, a replacement would be dispropotionately costly to them so i'm afraid they have actually offered you more than they even have to.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0
