    My understanding is that CT arrears for which the Council does not have a liability order are included in the bankruptcy.

    But once a liability order is in place, the arrears are not included in the BR.

    Council Tax under a liability order can be included in the bankruptcy.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
  • Should i call the 0871 (7p per minute on a BT but stupidly higher from any other phone) number and tell them I need it to do my job? Will they accept that? And then let them know that I only earn £126 a week so can't afford much by way of repayment?

    Will it work? keep him off my back a little longer until I save the rest of the money for the bankruptcy. Am starting to fret now.

    I would phone National Debtline for advice and maybe bailiffadvice online as they are bailiff specialists. Selling the car now it has been levied would be dodgy at best but could land you in trouble - please get specialist advice.

  • I have just come off the phone to National Debtline and they have said even though I need my car to do my job, because the car is worth more than the debt. They may still take it. I have to call them and try to negotiate and also send my budget sheet to the DCA recorded delivery and explain why I need my car. But she said they may choose to just take it anyway.

    Looks like I may have to give my job up and it took me a while to get this one. Am devastated. I was almost there too.

    Ask for a breakdown of charges - Bristow & Sutor will love that.

    Very much appears like this bailiff is trying to stiff you with charges, and he'll begin getting nervous once it becomes apparent that you're no pushover, and that his attempt at making a bit on the side may be exposed.

    The other thing is if your car is an essential work tool, I'm not sure if it can be seized. I'd say not.
