  • Well i am sure i remember seeing the car with cameras on it - i think it was slightly in front of me when i drove away from here once i had realised i couldnt park there! I have asked them for the video and pictures of around that time so i am hoping they will see me parking else where!! I did park in a location just round the corner that i could stop in :)

  • Oh just read your post again. No i didnt park in a car park. I parked in a layby which said you could park for 1hour max. I only wanted to put a cheque in to the bank (for less money than the blooming car park ticket!! ) LOL

    the location is High street, Wickford, Essex

    I was honestly there for 2minutes max - just enough time for me to reverse a little so i could see the sign and then i drove straight off.

    02: Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force

    If you were only stationary for that amount of time and you didn't get out of the car, appeal it on the basis that you were not parked or loading.

    Stationary and parked are the same thing. You cannot say you were stationary, but because you didn't get out of the car you weren't parked.

    Don't really follow you. Stationary I would of thought means stopped but not necessarily parked. Where as parked means that you have exited the car and left it. But thats just my interpretation. I would still appeal it.

    Unfortunately the law (and adjudcators) interpret it differently.

    If my car is 'stopped' but I am still inside, how long can I stay there until I become 'parked', would you say? 1 min, 5 mins, 15 mins, 1 hour?


    I would still appeal it.

    The OP can only appeal the PCN on the basis it was issued. i.e. Code 2: Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force

    The OP therefore appeals stating he was neither parked or loading/unloading as he was only 'stationary' for approx 2 minutes in order to check the sigange. Or i suppose he could replace 'stationary' with 'stopped'. :o

    No, I am afraid I have to disagree with both paragraphs above.

    There is almost always lots more that a person can appeal a Council PCN on than than 'the basis on which is was issued'! Pepipoo forums will explain if kaz posts there with a pic of the front & back of the PCN and a pic/Google link to the bay lines and signs:

    I think pepipoo is possibly offline at the mo, I can't get it to load so try later if need be...

    And Orford is right, do not even go there trying to argue that a car that has a driver in it is not 'parked'. Try Googling a few keywords to see how many times that question has been asked, and answered, on various forums. Stationary is parked.

    But that's not to say that Kaz will not get off this PCN. I would never tell someone to take the hit and pay a Council PCN without going to the adjudicator. Bearing in mind that you only risk possibly being told to pay the full fine and the odds are in your favour as most people win:

    Hi Kaz, perhaps you will come back when you have had the Video/pics? The vid should show how long you were... err STOPPED for. As I indicated before, if it was only for the duration that you claim, then I would appeal. If however, it was say in excess of 5 minutes then I would pay it. As far as I am aware, you are allowed to stop on yellows briefly (for like dropping someone off ect) but not to wait or err.. park. It costs nothing to appeal as long as you are within the time limits to do so.
