    Yes the mother lives alone in property owned by me and ex
    Yes I own my house with my fiance (hence the need for closure!)
    No my ex rents her house

    Not trying to do anything to ex i.e eviction etc as no need, just trying to end situation with ex mother in law and the house we both own.

    Erm mortgages is about £300p/m, there is quite a bit of equity now so could be sold.

    What do you mean to change 'status quo'? To what? Not sure can agree anything with ex?

    Can we get the court order to sell without ex's consent?? What about the fact that someone is living there?? Is it a good idea to stop paying mortgage?? What's the pros for repossion??

    No, divorce was finalised, nothing in declared in financial settlement as was declared as her unreasonable behaviour.

    If you threaten to stop paying the mortgage and/or put the house on the market, is there any chance your Ex & child would move back in with their Mother to stop this and claim it as the "family home"?

    Pro for repossession - you are no longer paying for a house that you don't have.

  • Ex and child won't move back in with mother if we threten to stop paying or put house on market, as she lives with new man in rented property with his children too!

    Mother has lived there since about 2006

    Whose fault and the grounds for divorce are immaterial.

    Was a financial settlement drawn up as part of the divorce?

    If yes then all assets of the marriage should be included - check the document.

    It's joint at the moment, but checking what we need to do for tenants in common and why we would be better of doing that?

    Your ex has you exactly where she wants you at the moment.

    No financial settlement so she can come back to you for money any time she wants. Are you in a pension scheme?

    As joint tenants the deal on the house will be 50/50 even if you have paid in all the money

    And in the mean-time mum get free housing!

    Did you use a lawyer for the divorce? Why did s/he and you allow this situation to occur?
