car insurance policy detail change con

please somebody tell me this is wrong :/

i took out my car insured in nov for myself with a full licence and my husband on a provisional, we took advantage of the "free" windscreen chip repair in december....now in feb and my husband today passed his driving test so i call rac who i brought the policy from [but its from aviva] to change the details only to be told that aviva wont/dont change details like that and they have to end the policy and start a new one??? resulting in, wait for it..... as ive made a claim on the policy i have to pay for it regardles of when its cancelled so im left with 400 pound to pay then id have take out another and pay for that aswell???? no surely not!the only other option is to change the existing policy by taking my husbands name off it meaning i get charged a 25 pound admin fee my payments go up 11 pound a month and heres the best bit....my husband cant drive it....this is what ive done as i was told i had to make a decision today(the word bullying comes to mind) but i feel ripped off and fed up and hubbys gutted as it looks like he wont be driving now until november when ive got my moneys worth out of the policy by still having it be valid....

has anyone else experienced this.....

    Where does it actually say that is their t&c's?
    I know it's normal not to refund after making a claim, but is it written anywhere?
  • Sounds like you may be talking to monkey rather than the organ grinder.

    It ought to be pretty obvious to any insurer that a driver on a provisional licence is going to pass sooner or later so if they are not prepared to accommodate the change they should have made it clear to you at outset. Otherwise they seem to be in breach of FSA principle 7.

    Contact the insurer direct and tell them you are dissatisfied with what their representative (which, for the purposes of this policy, the RAC are) has told you.

    Although it's the norm that you cannot get a refund after a claim, the RAC policy seems hybrid:

    They only take NCD that the main driver has earned elsewhere (even if the main driver is not the policyholder)

    They only give NCD to the main driver (again irrespective of whether or not the main driver is the policyholder)

    They won't let you change vehicle during the "renewal cycle" (last month of the policy). If you want to change vehicle in that time they insist on cancelling the existing policy and starting a new 12 month one for the new car. And still charging you their £25 policy change admin fee!

    And surprising to see the so called motorists' champion also includes the unenforceable "must have an MOT" condition, which presumably they use on ignorant policyholders whenever they can to get out of claims when their cert is out of date etc!

    Id start a complaint, so they would quite happily remove your husband but not change his details & I bet they would be quite happy to add him back on with the correct details........do they do this for every change by issuing a new policy???

    The RAC wanted OH to cancel his policy and take out a new one just for wanting to do a change of vehicle 6 weeks after the original policy was taken out. The car being changed was for the same make and model just 3 years newer! Not exactly a fiesta to a ferarri!

    They wanted to keep 40% of the original premium plus admin fee to cancel the policy after 6 weeks, which is probably in their T&C's but blimey! he asked if he could have a pro rata refund as he would be taking another policy with them to which they refused!

    So he complained, got the pro rata refund and went elsewhere.
