Esa Tribunal won... What now?

Yesterday I attended the tribunal for esa. I had a medical last april which deemed me fit for work, when in actual fact I am not. I appealed this and the hearing was yesterday. The tribunal has ruled that I am entitled to Esa, in the work-related activity group. I received a decision notice yesterday, which reads:

"**Name** is entitled to employment and support allowance (ESA) with the work related activity component payable from the beginning of the 14th week of entitlement."

What I do not understand is what is payable? I have been recieving a sum of £67.40 per week from the 12th April 2010 (this is what I have worked out to be my 14th week of entitlement, my claim started from 4th January 2010). There have been no missed payments, so can anybody tell me what this actually means please?

I'd be very grateful. Also, do I need to do anything with regards to the Job Centre (i.e. give them said decision notice)?

  • The work related activity group has an extra financial component of around £25 per week, so they'll be paying you that from the 14th week of your claim.

    The job centre might want to see you now if you've not been before as Work related activity group component comes with some mandatory interviews which differ depending what county your in. If they are doing their job right, they'll write to you.

  • Thank you very much for your quick and helpful reply. I was not aware of this £25 (or so) payment. Am I correct in thinking that this would work out at 12th April (the date my claim was accepted was 4th Jan). <- sorry, I'm not very good at wording things at the moment, I understand that 14 weeks from 4th Jan is 12th April, but I mean to ask, is that the date that they are referring to when they say "14th week of entitlement."?

    I'm in Scotland ,and have had a few appointments at the local Job Centre, which has entailed meeting with an employee and her checking my claim is all up to date, but nothing work focused has been discussed. She has offered me CBT within the job centre, but as I am on the waiting list for this from my psychiatrist, she didn't think it would be effective having two courses of it.
  • Yes the 14th week of entitlement 14 weeks from your date of claim. You should notice the back pay fairly quickly.
    It sounds to me like you've already been doing your appointments, I think there is usually 6 in total. They are supposed to be work focussed, but it depends on the individuals circumstances. When you see your adviser at job centre next they should be able to confirm this.
  • My goodness, well that's some very good news. £25 per week from April last year til now = the ability to use my gas cooker and heat my house for the next couple of years :) I wonder if it will all come as a lump sum or divided into my future payments. I shall ask at my next appointment if it is work focused interviews, the lady usually speaks of her best friends wedding in which she is to be bridesmaid.
