  • I can't see what the police can do - even if you can prove who took the money, all the police can do is arrest them. It will be up to the criminal courts to decide what to do in that case. Even if you win the case, there is no guarantee you will get the money back. Same goes for if you drag them through civil/small claims courts.

    If you are lucky, they will have assets that the courts can re-posses - but if they haven't your stuffed. Also there are the court fees to take out as well.

    I presume you are not worried about the bad feeling that the police/courts will cause, seeing as they have had the gall to do this in the first place.

    I know hindsight is 20/20, but this is why you should NEVER give anyone your details, no matter how close they are or how much you trust them. And if you do trust someone this much, you MUST keep an eye on your statements and cancel cards the moment something doesn't seem right - this might still be too late.

    Has the relative been confronted by the family, if so what is their side of the story.

    It would be very easy for the person to say they did have authority to take the money (ie grandmother was making them gifts) and very difficult to prove otherwise.

    Would grandmother attend court to testify one way or the other? If not I suspect you are on a loser

    But why would she make 'gifts' to the point she is penniless? Fortunately even the police use some logic (at times). And unfortunately they have adequate practice. As this sort of bleeding dry is not uncommon in care homes - particularly where there are no surviving relatives to ride shotgun.
    If you want to test the depth of the water .........don't use both feet !
