  • Annual leave starts in September so I would be entitled to more than 9 days. I've severely mucked up :(

I've not got a copy just now but will get it tomorrow. ut say effectively if they won't give me the SMP without the break then I have technically returned to work and if I can get a sick line then I would just be off on the sick?

That's right. But bear in mind that sickness in local authority is on a rolling year. So any sickness you've had in the past year will be deducted from your entitlement. And by being off sick now you'll reduce your future entitlement too.

If you'd budgetted for SMP, try and get back on maternity without a break if you can. You'll get the money for your leave later on than expected, but at least you'll still get it.

Our leave year finishes end of August, and I have to take my leave for the whole year before I go on maternity because I will not have the opportunity to take it otherwise due to maternity. That's what our maternity policy says anyway. So I am padding out my maternity leave by taking my remaining 3 weeks annual leave for this leave year before my maternity leave starts, meaning I can finish at 35 weeks but not start maternity leave until 38 weeks.

    That works too :)

I would give your employer's HR department a call first thing and explain you misunderstood the way it works.

  • Ok, sorry I have had to post again but I am wracked with worry now.

What if they say no? Then what am I going to do for money seeing as I will be effectively still at work just unpaid? How am I going to feed my kids and pay my rent.

I genuinely can't be back to work yet. I don't have the funds for nursery at the moment as I wasn't expecting to go back until June. I don't have the money for the travelling as it's over £250 a month. I won't be able to claim any benefit and won't have any income coming in except my partners IB. Will I get help from anywhere? :'(

If things are so tight why did you take your managers word on the maternity policy and not get a copy, go over it with a fine tooth comb and ask for any clarifications with the answers in writing?

You wont be back at work for no pay, you will be at home for no pay and I cant see benefits filling the gap unless you go sick but then it will be £65 pw ESA.

You might get LHA eventually but it takes week and weeks to sort out from the posts made here.
  • If I went on the sick I would be entitled to six months full pay but hopefully my employer can sort something out.
