DMP, Claims and Bankruptcy advice needed

Hi All,

I was on this site just over 2 years ago and after much deliberation, I decided to enter into a DMP in which I pay £300/month. After 2 years, I am not sure if I made the right decision because of the following reasons...

I have already filed claims through a company who:

A). Request a copy of my CCA (I am now aware that I could've done this myself).
B). Send it to an independant company who looks through the CCA to see if there are any loopholes which make the contract unenforceable. A report is then written and submitted to a board of solicitors who then make the decision as to whether or not the CCA is enforceable. If it is enforceable, I still owe the full debt to the original creditors. If it is deemed unenforceable, then I will owe the company which filed the claim 30% of the total they had written off i.e. £10,000 credit card deemed unenforceable, I owe the claims company £3,000.

The total debts I have are:

£39,204 Credit Card Debit (of which one with Marbles for £10,280 cannot produce a CCA and have said that they're not going to chase and another with Barclaycard for £7,433 haven't produced a CCA or any form of contact since the request was made over 2 months ago. All other CCA's have been produced).

£22,238 Unsecured Loan Agreement - CCA Produced.

£1,581 Overdraft

£5,200 Car Finance Loan for a car which I still have and require for work. I owe more on the car than it is worth. Can't give it up as I need it for work. Last payment is Feb 2012.

I can't make claims against the Car Finance Loan or overdraft but if all the claims are successful against the Unsecured Loan & CC's, then I will owe the company £18,433 for getting the remainder of the debt written off. At £300/month, I would be paying this off for 5 years.

My partner & I are thinking of starting a family in a couple of years and I don't want to ever be in a position where by my partner has to make the payments for me as a lot of my debt is due to exs and my own stupidity.

I'm wondering now if I should just go bankrupt. Can anyone give me any advice please & thanks!
