Overpayment Need Help!

Hi, thanks for taking the time to read this as we are in need of some serious advice on what to do with the information sent to us today!

My Mother received a letter from the HMRC Tax Credit Office today stating that she would have to pay £1,904.49 in child tax credit overpayments. They are£964.60 2007-2008, £459.30 2008-2009 and £126.43 2009-2010, £388.88 2009-2010.

They are asking us to pay this back in full.

My mums already tried to dispute what they're telling us but have made this letter they're final decision. Now, as my mum is all on her own and has been for 6-7 years bringing up 2 kids, I'm incredibly upset to see this. She had no idea that by claiming 'credits' on the money she's earning to help her raise Us, would come to stab her in the back like this. I'm angry that the government offers this help to people who have no idea how these things work and expect them to be the ones keeping tabs on it. Surely its the responsibility of the HMRC to make sure there are no overpayments, and any that do happen should surely be their own wrongdoing which they should have to pay the price for?

I know this sounds like an anti-establishment sort of rant! But I need to know if any one else has been in a similar situation, what did you do, who did you call? and how can I tell them to !!!! off and leave us alone!?!?!

    You phone HMRC and ask to arrange a payment plan to repay back the overpayments, there is no "get out clause".

    All the relevant documentation is available to the claimant every year you re appply. if people are unable to understand the documents would be a good idea to seek advise from establishment like the CAB.

    Its a good job they didnt "leave you alone" when you claimed or you would have got nothing off the state. Your mother invited them in to your life, you can't just invite them out.

    She would have had to sign a declaration every year to agree to income and what would happen if they overpaid her.

    First check the overpayment is correct. Then ask for a playment plan.

    I'm going through similar myself. I was told I owe tax credits 2000 and carers allowance 6000. I am absolutely devastated. Not because I need to pay it back, I accept that, but because I was given the wrong advice at job centre plus. when I started working again and that's why I now owe the carers allowance 6000. I will probably go to court for this and be given a jail sentence. Don't think I can do that one.

    I didnt know that primary school aged kids were allowed to post on this site, you learn something new all the time!

    Tax credits arnt a credits at all kid, they are benefits that your mother claimed and she had to make sure that they had the full information at all times, she didnt and now she must repay this money, remember that when your a big boy and old enough to get a job and you should be ok.

    Is this the first letter that your mum has had with regards to the overpayments? As you mentioned that this is their final decision. If your mum looks over her awards notices for the last few years, she will see on the documentation that there are overpayments. Possibly the error made is that the hmrc have not deducted the overpayments from future awards, or, that the deductions have been made, and they are looking for a quicker settlement.

    Has your mother claimed CS from your father? that is a great help too in helping to provide for children when you are a single parent.
  • Has she checked the figures to make sure they were correct for the overpayment? Did she update her details at every change and have it confirmed with a new tax credit award? Does she have dates/times of calls to HMRC?

    If she feels that the overpayment is incorrect she has to fill n a dispute form that HMRC can send out should you require it. If HMRC decide that the overpayment is correct you she will be able to set up a repayment plan to pay back the monies owed.

    Just to add I don't think you should be so rude to people who have gave you advice on what to do and weren't at all disrespectful to you, they didn't have to spend their free time giving you advice. . . . .
