    Big mistake i think. I wouldnt have sent that until i had the cash in my hand.

    The car was left in the yard because it was still being reviewed by the 3rd party through an independent solicitor, which i explained in earlier post. The car has been deemed as a total loss by Hastings, They never at one point contacted me to come and collect the car infact they were not very customer freindly anytime i called them and its contsant hanging on. When i spoke to Copart a few months back they advised they were waiting for HD direction.

    OK, so firstly have you definitely checked all your correspondence with Hastings and can you confirm that nowhere in the correspondence they advised you that the vehicle was clocking up storage charges?
    So HD had ample opportunity to have returned the car,

    This leads on from the point above - if they did advise you that the car was stored with Copart and it had to be collected then it would be up to you to collect it - it would not be up to Hastings to deliver it to you.
    I think they have forgotten the car was still there because they lost all the car documents and copart called them about the storage charges and they adviced Copart to sell it off to cover the cost without contacting me. So Raskazz please explain how they have acted in my best interest when i have lost over £3500?

    Becuause, as I said, if they did advise you that the car was stored with Copart and it had to be collected, and you just simply ignored them, then you would be liable for the storage charges. Once the storage charges exceeded the vehicle value, they would be acting in your best interest in selling the vehicle to cover those storage fees and prevent further fees accruing.
    I am not laible for the storage charges as i was told by Copart and HD in the past as this will be claimed through the 3rd party, the car was taken there by HD and not me.

    There is no way on Earth the 3rd party will cover the whole 18 months storage fees as the storage fees have clearly not been mitigated at all in this respect. And again, it does not matter that the car was taken to Copart by Hastings, what matters is why it was left there for so long. Which is why you really need to read all of the letters that Hastings sent to you, if you haven't already.

    All very true but nothing gives the insurance company the right to sell the car without warning the owner that they were going to do so unless he collected it within say 14 days.

    If they accept the claim is valid then they should pay out, pay the storage charges and can do what they like with the car.

    If they decline the claim then the storage charges end up in the OP’s lap (with a possible argument about some of them are due to unreasonable delay by the insurance company) and he can pay them and take his car back.

    Sounds the best way to go at this stage, (apart from the waiting maybe)

    Am glad to say, the 3rd party have paid for the car, and Hastings are fowarding me the cheque , it nice to have a closure after 2years. Thanks for everyone contributions
