Made redundant from part-time job

Hi,

Three years ago I took on work in local village shop to help out. It was a cash in hand job and I only worked eight hours a week. However over three years have passed and I am [was] still working there, that was until I got phone call last week from the owner to say that due to financial problems he was going to have to let me go!!! Should add that as I was out at the time of the call this message was left on my answerphone.

This is a small concern only a few staff, but there are two new staff [family] that have only just started working there.

Am I right in feeling I have unfairly treated, do I have any rights as this was a cash in hand job, am I entitled to redundency pay?

I have to add that this was the only income I received other than a small widows pension of approx £80 a month, so have not been avoiding paying tax!

    In simple terms, you should phone ACAS. Did you even have a legal document, hence contract stating that you were employed? Did you ever pay taxes for the money you received by cash in hand? If not, redundancy pay - government based, is actually based on your NI, I believe? I stand to be corrected on this by other members.

    OP wouldnt pay tax on 8 hours a week, nor NI. There is no need to state the words, 'cash in hand' as you wouldnt be paying tax anyway,
    it makes it sound as if yur doing something wrong.

    Are they offering you any sort of compensation package or just telling you 'dont come back'
    I would have thought you were entitled to some sort of notice, 3 weeks spring to mind as you had been there 3 years,
    and if redundancy pay applies, then that should be 3 weeks also, 4.5 if yu are over 41

    I would ring ACAS, They are the best people to guide you.

    I never had a contract, and I wasn't paying tax (didn't earn enough) or N.I.
    I was basically told I was no longer required, no notice, I have never had holiday pay either or wage slips.

    I am not sure how the business was run, or what the owner declared to the tax man etc.

    I think I will ring A.C.A.S and see what they say.
    Just don't want to get into any trouble, I know I wasn't earning enough to pay tax, but obviously I should have declared it??

Payslips are a legal requirement - your employer should have provided them whether or not they had to deduct tax or NI. You were entitled to paid holiday but if you didn't claim them, you will have lost them other than those accrued in the current holiday year. (Your year will run from the time you first began working there.)
