I don't quite understand why you didn't you just reclaim when your claim hadn't been stopped?
The overpayment wouldn't have been anywhere near as much as your claim would have been backdated for three months which would have been closer to the renewal time.
You will have occured an overpayment from April - June as they kept paying you and because you didn't renew then you didn't qualify for tax credits for those months.
You will be liable to pay the overpayment back but this can be taken off your new award.
£1400 for 3 months of tax credits seems excessive for someone who doesn't seem to have any bother for not getting them anymore.
I'm a little confused.?0 -
The overpayment will still stand and if you put in a new claim they will not be able to take it off the new claim, its a seperate claim. The overpayment would of been avoided if you renewed the claim by the deadline, it would of been terminated at the start of August and you would of been give 60 days to restore the claim from that date so there is no wrigggle room as you have had plenty of time.
You have to call the helpline in order to get a new application form, and you can call the overpayment helpline 0845 302 1429 to arrange to pay back the overpayment for the previous claim.0 -

It's probably not just 3 months but the whole of the last tax year! The "renewal" is also needed to finalise the award for the previous tax year (as actual income is needed), if they don't get this they can reclaim the whole of the previous tax year's payments!0 -
how long did you go abroad for? the forms are sent from April to end of June and once the 31st July deadline has passed you were given a few days grace and then by the 2nd week of Aug they began terminating the claims, once terminated they would of sent a letter to say you had 60 days to restore the claim or else the claim would be permantely terminated and any money you have been paid since April would be classed as an overpayment.
The best thing to do is make a new claim for tax credits if your still entitled, you can arrange to pay back the overpayment in instalments, they wont ask for it all back in one go, you can discuss what you can afford to pay on a monthly basis and they will see what they can do, but just saying you cant afford to pay it back wont wash with them im afraid and they will keep sending you letters about it.0
