Incapacity and 52 week ruling

Please could anyone give me some advice regarding Incapacity benefit and the 52 week ruling, I think thats what it is called.
I am enquiring for my Mother who was on Incapacity Benefit for a long period of time. It was classed as non taxable because she had been on it that long suffering with depression. Last year she decided to get her life back on track and got herself a job and was told she qualified for a 52 week ruling, so that if she went sick she could go back onto the same benefit.
After approx 7 months of working she hit rock bottom again and had to sign on sick so what I am wondering is what happens with benefits. Is it exactly the same so it will be classed as non taxable ? Will she have to go for medicals ? I have tried looking but not found much information out im probably looking in the wrong places. Sorry if this has been covered but I could not find it.
If you have any information at all it would be appreciated.

    I would think that it would still be non-taxable but it would be best to check with the DWP or with a Welfare Rights officer. She will have to have medical checks every so often just like everyone else who is not exempt.

    I know that after 52 weeks on Incap benefit they class you as being disabled or long term sick - this would probably mean that the rate goes up slightly. I don't know the answer to the tax question though. Sometimes after 52 weeks sick notes don't have to be provided any more but medicals are scheduled from time to time by the DWP. However, as your mother has been back to work I would think that the sick notes would need to be provided again. Not certain though.

    Hi,

    So far as I can recall the 52 week ruling refers to the fact that she will go back on to Long Term Higher Rate of IB.

    Sick notes would have to be provided.

    The tax question is tricky and you will probably need to speak to IB direct about that.

    hello,
    i have the same thing a '52 week link' is what they call it. I too have gone back sick again. I thought i wasnt being paid anymore so rang the IB line( a few weeks ago). They asked me lots of questions & forwarded forms for me to sign. I mentioned the 52 week letter i have & they said to send it off with my application. Then before the forms arrived i saw i was still being paid & will be so for a couple more weeks. I therefore cancelled my application. Dont understand the tax thing, i am not sure whether i have to be 28wks sick before reclaiming IB. Hope this helps! Tell your mum she has done well to try & get her life back on track. I hope all goes well.
