Please Help, IVA Approved, mortgage applied for court and order AND TOLD THE COUNCIL!
Options
Hi,
This of you who have read my previous tread will know that despite having an IVA approved, the mortgage company have pursued for a Court Order for Repossession BUT ....
Came home to a letter from the Council to say The Northern Rock have contacted them to tell them they are going to repossess our house!!!:mad::eek:Despite our Specialist Adviser saying a Suspended Order is likely.
Can they do this?? Why have they done this! They haven't even let the right Council know!!! The letter has come from a neighboring council which we don't fall under.
Isn't this against Date Protection?
Are we more likely to be repossessed now?
Please. if anyone can advise I'd be grateful
Thank you
D

This doesn't sound right. A lender would not normally contact the council. However, do the council have a charge over your property (perhaps for previous unpaid council tax arrears????). If they do it may be they have requested information as they have an interest in the security (property).
Lenders do not give out information willy nilly. If it is a neighbouring council it sounds more bizarre.
What are they saying in the letter? Are they offering you assistance if your property was repossessed? Is it a case they are being pro active due to the number of repossessions?
Your best bet is to contact the council who has sent you the letter and ask them why it has been sent. If you have a court order on the property you need to speak with your lender to get an arrangement put in place. They would normally settle for the normal monthly repayments.
Hope you get it sorted.0 -
Yes I thought it sounded odd and I've had a sleepless night because of it!!
I am furious now to be honest, isn't this directly against Data Protection? Also, they've told the wrong council!!
I do have arrears with the right council, but they are included in the IVA and certainly are not secured on the property.
This just seems such an odd thing to have done:mad:When looking at the climb in front of you, don't forget to look back once in a while and see how far you have come:j
