    Only if you let them. It is just about feasible that they have twisted the vendors' arms to specify that only so called 'qualified' offers will be passed on. But more fool any vendor who goes along with this - probably a letter through the vendors door stating that you wish to make an offer but the Agent is obstructing would bring about a swift change of mind.

  • Letter of offer should be in writing and in an envelope with the property address stated on it. Two versions.

    Make a further appointment to view the property say you are about to offer on another property and want to make sure this is the one for you but you really liked this one.

    When you are done tell the vendor that you will be making a formal offer in writing to the EA tomorrow am. Drop the letter into the EA.

    They will be gagging to know about the offer and will be all over the EA like a rash the following morning. If you don't hear anything that day regarding your bid then drop the copy of your bid to the seller and add a note saying this is the offer i made to your EA but I haven't heard yet.

    This will enable your seller to negotiate a compromise fee with the EA as they clearly wont have put forward a valid offer in contravention of the act.

    I don't see how they can 'prevent' you from making an offer

    Put it in writing, post or deliver it to them. You've made your offer, and they haven't stopped you.

    You don't have to wait for them to say "It's OK for you to make an offer" you just make it.

    Thanks they refused to pass on my offer to the owner until i saw their advisor and said it had to be in person grrrr! lol but all sorted but a huge waste of everyones time! They make me so mad they then tried to tell me that my home insurance was no good.... I sell it! haha o well deep breaths!
