It'll be easiest if Apex help. If they don't, they deserve to reimburse you for all the misery you've been put through (as far as money can).

WOW. You're in almost exactly the same spot as I was in. In those days house prices were rocketing.
The reason I mentioned 6 years was that I noticed you've already been battling them for 7!
When did they post the original default?
I was "done" within a year of a fabricated contract.

That's a good point - I didn't think to check the date. I'll have a look at the credit report and let you know. I do remember, though, that the amount they claim default is somewhere in excess of £7k, whereas the original agreement amount was for £3k. So the amount they're claiming includes their charges and other bullsh*t. Ok, I checked my paperwork and Apex have definately mucked up big time! Having said that, they applied the default three years ago, which means that there are only three years left to run. I have been able to obtain credit since then without any problems (which was my main concern). I doubt very much that I'm going to have enough for a deposit on a house in London in the next three years, so am I not better off without the hassle of suing Apex? Don't get me wrong, I love nothing more than to take down big fatcats, but I really don't have the energy to deal with these morons.

You're lucky to still get credit.
You'll need advice from someone else regarding the default being put on after 3 years. I think they need to put it on earlier.
A small claim isn't too much hassle and would certainly get them thinking to remove the default but if you're happy to wait 3 years, you may as well.
Amazingly, you're still getting credit. Very lucky. Defaults usually annihilate creditworthiness, even settled ones.
