Where do I stand?

If EDF cancelled one half of my DD in December 2009? My bank had sufficient funds in it and Santander did not inform me as they say that they only write to confirm if a customer cancels a DD.
I'm still paying my Electricity DD, but why would they do this? They can't give me a reason so I'm wondering what my legal position is when they are tryig to recoup the whole amount.
No smart answers about 'well you should have noticed' I did, but only a year later!

  • Not a "smart" answer but why did you not check your quarterly statement via Online Account or Paper Bill. You surely would have noticed this not coming out on your monthly bank statement which can also be paper or done online.

    You have used the energy so you should expect to pay for it in full. You could ask for a repayment plan perhaps spread over the year that the "Debt" was accrued but thats it really.

    The legal position is that you will owe what you have consumed.

    I've no idea why the supplier would have only collected a portion of what you owed at the time, but they would have told you how much they were collecting in advance.

    If the supplier didn't even bill you some consumption, you may be covered under the 12 month back billing rule for that.

    EDF can't cancel a DD, only the account holder (you) can do that. What they have failed to do is to take the DD-but it still remains active unless you cancel it.
    No free lunch, and no free laptop ;)
  • Well, Santander and EDF have both confirmed that it was cancelled. Hence my confuson.

    In that case get on to EDF and ask them why the cancelled it. All billing systems have some form of audit record so that should indicate if it was done manually (CSA) or automatcally (system). Did you move from 2 single fuel tariffs to a dual fuel tariff by any chance?
