Help with father i laws claim

Hi there, i recently won a claim against Lloyds TSB which i posted about.
Now i am helping my father in law claim for a PPI on a loan he got 5 or so years back with Lloyds he was sold it while he was in a period of employment where he was regularly in and out of work, and was sometimes self employed (due to the nature of ship yard work).
The problem is he has very little proof, he managed to get a letter from one company just saying "he was employed from-to on various contracts.
He says while applying for the loan, that even though he was in and out in various contracts, that it was still considered full time/permanent due to the small gaps in employment.
At some point he became unemployed for a few months and tried to claim on the insurance to pay his loan, but was told over the phone that he wasnt covered as the job he was in was temporary!!
so he struggled on and made the payments himself.
He became employed again a few months later, and paid off the loan in full.
I ave sent off for and received he SAR,so i have all his credi checks ect and loan aggreements.
When i did it, i sent a letter from a template on here, but i think it has now changed to a form.
Could someone please give me a link to the right form and address to send it off to at Lloyds.
Also what do you think his chances are, obviously i think i will need to emphasise the fact that he was told t was suitable and that his employment was condifered Permanent/ full time by the insurance salesman.
Thank you for any advice.

Hi there, you seem to me to have very good reasons here for a mis sell. Take a look here for reasons for mis sell.
http://www.moneysavingexpert.com/reclaim/ppi-loan-insurance#checklist
(as there may be others that you may not be aware of)
Also on that link you will find the template letter for the mis sell. If you feel able to , you can write a letter in your own words to the effect of... i believe i was mis sold this ppi because.. and give the reasons. That is all you have to do. You can use the template letter but if this goes to fos, then you will have to fill the template letter in again, and the letter will get you the same reply. The choice is yours. Good luck with this and please keep us posted.

If the loan was sold post 2005 then a demands and needs document would have been produced showing that the policy was recommended for him. If he tried to claim and was told he could due o his employment status then the insurance underwriter will be able to provide this in writing.
have u got any policy information? alot of self employment terms are not onerous. if you can find the term post it on here and i will have a look. If, in order to claim, he had to 'permanently cease trading' then thats an onerous term o if it was an advised sale then the case will be upheld by the ombudsman.

There was no demands and needs document with the sar w rceivedthat i seen, there was the credit check thing they did when he appliedfor he loan, stating his reasons, employment status ect, that was all oped and sent off along with the complain.
How long have they supposed got to investigate, is it 4 weeks or 8 weeks?
Thanks all again.0 -
They are supposed to get back to you within 8 weeks but don't be surprised if they tell you they need more time to investigate after that time. Also, after the 8 weeks if they have no solution for your case, you can go to the FOS straight away without waiting for them.
Good luck0 -
Ok, got a response through yesterday.
Basically they are sayng the BBA is fighting the FOS in court in dispute as to how the fos is ruling on PPI's, and, until the court rules, they wont be make any decicion on this matter.
What should i do now?
Thank you all.;)0 -

Hiya
I received my letter update from Lloyds yesterday (Tuesday), and was also informed the same as you, but I am prepared to sit it out.
They did however enclose the Financial ombudsman service (FOS) complaints leaflet, so I can make a complaint to them now if I want to, but the thing is its the same for the FOS as well.
So I am giving it longer and hopefully a decision will be announced very soon, fingers crossed and with yours too.The one and only "Dizzy Di"0
