You should also keep receipts for any public transport you have to use and the storage of your car in the meantime and ask them to reimburse you.
The costs should be reasonable. You will not get back what you spend on a private jet but bus and train fares could be asked for.0 -
Yes. I agree they are definately trying to wriggle out of it. The accident was the 15 Jan they repaired her car within a week it was when she put in a whiplash claim that this has now come about. their letter is dated 3 Feb.
Also there no damage to my car apart from a dented number plate. So didnt put a claim in for me.
The thing is can they use the fact that the date is incorrect to void my insurance whoever is to blame for the error (date previous accident on policy) its my word against theirs
How was the quote done/accepted, online or phone? If phone, ask for the call to be listened to.0 -
It was completed online. I knew the month and year of that accident but not the day. I find it hard to believe I got it so wrong! If it was my mistake it was a genuine one. If I deliberately put the wrong date in how would it benefit me?
I know I have a battle ahead of me. The damage to the other car was minimal but I guess whiplash claims are quite substantial and I guess they dont want to pay.
another thing I am worried about is, are her insurance company and solicitors going to come to me for money? I am a single parent with 2 kids and live in a rented house so have nothing to give. My car not worth much either.0 -
They could just check on CUE and see that that isn't the case? 2 second job
They could check on CUE but they may suspect there is an accident / incident on the date that does not show on CUE.
As best practice they should really have asked for a written explanation from the OP as to why they made the non disclosure / mistake. This helps the Insurer work out the intention of the non disclosure eg Inadvertent or Innocent etc etc and would flag up whether there were two or just one accidents.
I suspect this has not happened as I cannot see that one accident which was actually older than disclosed would mean that the Insurer would not have accepted the OP as a customer had they known about it when issuing the policy.
If the OP had been playing around with the dates on the accident on their quote system to find the date that makes the Insurance cheaper (Assuming they discovered this) then perhaps it could be classed as non Inadvertent. This might warrant voidance but this is arguable0 -
Getting more complicated. I rang One Call yesterday, asked for the manager but the person I was speaking to asked me to go through with him first before putting through. Which I did. He kept putting me on hold which turned out at the end of the call he was referring to his manager! Anyway, the outcome was I was to provide the name of the insurance company at that time so they could confirm that I didnt make a claim on that date. I was ringing from work so didnt have that info so it was agreed I would ring back the next day.
I rang this morning and provided them with the insurance company at that time.
The thing is on ringing the insurance company first (More Than) to check I was insured at that time and to confirm I didnt make a claim on the 1/6/07 they confirmed all they had on record was the incident on 20/7/06 but also an at fault accident on 12/2/07!? I didnt make a claim on 12/2/07 - what happened was a sheep had escaped over a broken wall on to the road, it was dark and didnt see it until too late but there was a car coming in the opposite direction so I couldnt drive round it. I was doing less than 30mph but couldnt brake intime and bumped into the sheep. It wasnt killed but it was injured. I didnt know what to do so rang the police so they could contact whoever owned the sheep. I informed the insurance company straight away for advice on what I should do but no claim was made.
To be honest I had totally forgotten about it and didnt think I needed to put it on the form as it wasnt a claim and wasnt my fault even though I have now discovered they had put it as my fault. I never received anything in writing from the insurance company.
So now I am worried that this is going to come up now. In the 20 years I have been driving I only ever had made 2 car insurance claims 1 was when someone dragged a key down my new car in Nov 2003 and the accident on 20/7/06 which the claim was less than £300 I had bumped into the neighbours parked car. That's it!
I am never going to do an application for insurance online again. Its better to speak to someone in person and at least its tape recorded!
So basically, what I am worried about now is what will happen to me now? I can prove that I didnt have the accident on 01/06/07 which is the date on their computer but now they may try to use the sheep incident. Will I be taken to court, have a criminal offence be put on the fraud database? Any advice would help please havnt slept for the last two nights worrying about this.
Also can I ask to see what information is held on me on this CUE database? So I know in future exactly what insurance companies have on their records about me? So I dont make the same mistake again.0 -
Makes it a lot more difficult for you.
Your previous insurer are counting the incident with the sheep as a claim. You would need to get them to correct this. Onecall probably would hold up on revoking otherwise.0 -
Thanks for that. So it is possible to get it changed?. Had I known at the time that they had counted it as a claim I would have rung them. At the end of the day there was no claim I was just notifying/asking for advice.0
