Hi all, been looking through site for a long time but signed up today to finally take some action.
At the minute I'm just looking a bit of clarification.
I sent the template letter requesting a copy of my contract off to Santander on 6 Jan and have not received a reply yet.
I'm just looking to know what to do next. Do i resend the letter again, phone them, or give it more time. Not sure legally how long they have to reply to me.
Any help would be appreciated.
The issue is with a flexible loan i have had for about 9 years i think. I originally went to Kerobo and paid them to deal with 3 cards and this loan but as we all know got nothing back from them that was constructive and lost my money but they did say i was paying ppi on the Cahoot loan, so looking to see if that is the case.
Many thanks
Mark

Forget requesting a opy of your schedule etc if your planning on making a complaint. Just send in the missale complaint (aking sure you make it relevant your facts) and wait 8 weeks for your response. The bank has 8 weeks to respond legally under DISP 1.6.2. I imagine that there is no legal time limit for requests for policy information so put in your complaint if thats what your looking to do.
if you have any questions about whether you have a good case for any of the loans etc then just reply to this. Cheers0 -
Hi Thank you for your help.
Just got the document from Santander with the copy agreement signed by me in 2004.
There is another sheet which has my signature on it and the PPI part. In it is just says, "We strongly recommend you to protect your loan repayments for a monthly fee of ust 72p per £100. Tick here (only if you have not applied online) for cahoot payment protection."
This part is left unticked, so I am not sure if I have been paying it or not. I thought I would have received a document to state whether or not I had been paying PPI. The loan was applied for online but thought it may have been the entire application with the boxes ticked or not ticked that I have made at the time.
Really confused now as to what to do. Do I write to them and ask if I have been paying PPI on this loan?
Anyone else applied for the flexible loan online could perhaps point me in teh right direction.
Many thanks0 -
Hi there
Give them a ring as a general customer query, and ask them about the PPI, if they say yes ask if they could supply you with the written documentation.;)The one and only "Dizzy Di"0 -

Does this document have COPY written on it? As the banks often send these computer generated copies which do not show if you ticked or signed. Cheers0 -
Hi, no this appears to be a fax or photocopy of "Credit agreement regulated by the consumer act 1974 flexible loan" States the apr interest rates and repayment info without the loan amount or how much I should be repaying. It just seems to be a generic statement on that first page. The second one is my signature and signature of the creditor on behave of cahoot with the info about ppi. The other 33 sheets are the terms and conditions for cahoot.
I have this loan and several credit cards all under a debt management company, so do not get statements from cahoot, nor do I have access online, so not sure what I had been paying. I was going to ask if I could have a statement of payments over the past years, surely this would show if any ppi had been paid by me on the loan.
Bit hesitant to ring up and ask them if I had been paying ppi for that would just show them that I am not aware of the situation and what is stopping them saying I have not been paying any.0 -
How far did you get with this...Im in the same boat0

If you did not get a response from them then its highly likely that your letter did not reach its destination. They would send a letter out to you to tell you they got the complaint and its going to be investigated. You would then get holding letters at 28th and/or 56th day.
If you have not gotten those then they did not get the letter.
So give them a call, but much better is to write to them again with a copy of the original letter.
They get so many letters and calls that they are struggling with the amount of compalints coming in. But they are paying out on everything PPI and MPPI related. As long as the complaint is structured correctly.0
