Mike St Helens, if you don't mind me asking, what happens, do they take everything you own away in a van? I know they won't take the sofa, cooker etc. but what about stuff you can't prove you didn't buy? we got a tv from the parents as an xmas present but can't prove it - the other half is concerned they'll take it and things like that.

Sorry if this is getting off-topic, take it to PM if you want.

have a look at the Bankruptcy supporters thread. You will be surprised at the info and advice on there. They wont come along at all.. Unless your hidling a Van Gough under the bed !

Hi ya, I had the same problem with Halifax too! My husband in in the early stages of a DMP with payplan (odd thing is that Halifax HAVE agreed & I was expecting them to be difficult) but they still continued to call. Its made even worse by the fact that my husband is in Afghanistan for 6 months with the forces so I'm having to deal with everything on his behalf (Lucky me hey?) & the girl who called made me sooooo angry - even after I told her he was away for 6 months she still said "ok, thank you we'll try again next week", I responded "no, he's away for 6 months" she responded " ok, thank you we'll try again next week" this went on for a few minutes, until I gave up and put the phone down.

Things have eased off now though so hopefully in time they'll start to leave you alone.

Keep your chin up & hope all goes well with the IVA.
  • I have the same problem, but i'm being hassled by the Halifax AND Co-Operative Bank! Even though I've spoken to someone already they continue to phone, so now I ignore their calls!!
  • Yes I am starting to ignore their phone calls too but I don't think that will help!

Not that they are listening to me either!

Thanks Mike St Helens for your comments - I have been following your postings as I remember you PM me as my husband and I also got swindled by the brewery!!!!

Thanks for all of the support that you guys have given and the good luck messages - much needed at times!

Here's a copy of the letter that I sent to them:
    Halifax Bank of Scotland
    Retail Bank Collections
    PO Box 607
    Trinity Road
    HX1 2UJ

    Account Number XXXXXXXXXX

    30th October 2006

    Dear Sir / Madam

With reference to the above account, as previously requested on the XXXXXXX and on numerous occasions since, please address any correspendence to me regarding the account in writing.

Please stop immediately attempting to contact me by phone, the number of calls now being received (10 to 15 per day) are bordering on harrasement.

As previously stated I am fully committed to resolving my financial circumstances in a beneficial manner for all parties involved, but your actions are not helping matters. I have recently sent you an informal debt management plan which I hope you can accept and freeze charges and interest as to help me resolve my issues.

I understand your company uses a dialer program to dial phone number automatically, therefore I will give you 3 working days from delivery of this letter to remove my number from your system, failure to do so will result in a complaint being registered with the Office of Fair Trading as it has now been nearly 3 months since I first requested this and nothing has yet been done.

I look forward to hearing from you within the next 7 days to confirm my request

    Yours faithfully

The result was the calls stopped after 3 days and they could not apologise more if they tried.

  • I had this probelm last week with the Clydesdale Bank. I kept ignoring their calls but in the end it got too much and I answered on Saturday night at 7:30pm, They asked me could I confirm who I was and what my address was, to which I replied 'yes, I will but only after you give me details about my account'. To which her reply was 'I cant give you details as you need to authorise me'.
My answer to that was 'You could be anybody telephoning me and I am not prepared to confirm anything and if she was genuinely from the bank then I suggest she send me a letter, to which I would reply immediately'.
The phone calls stopped that night and I got a letter on the tuesday. I telephoned and dealt with it and also told them that I would not be answering calls if they couldnt prove who they were, so would be a waste of time phoning me again. The calls have stopped.
  • also get an answer machine "please leave message after tone" they never do and it is nice to hear the sigh of frustration on the other end after they have rang 10 times to no avail
  • thanks for all that advice. however last week the phone calls stopped but they went ahead and took £684 out of my account (wihtout telling me!) to cover the backlog of personal loan payments even though our IVA meeting is on monday morning (11th)!

Our insolvency practitioner has told us that they are not allowed to do this but now when i keep phoning the halifax they tell me that it is tough!

has anyone else had this happen to them?

what do i do now? £684 was the first amount of the IVA payment right out the window!

Hopefully your IP will complain to the HALIFAX - if they were aware of the creditors' meeting, then they must have known that they were acting unfairly.
I think, also, that you should continue to phone them, ask for the name of the person and once they tell you 'tough' again, inform him/her that you or your IP will be complaining to the FSA, Trading Standards, Banking Ombudsman and any other relevant organisation.
Strange that they can get away with doing this to you, yet you are 'not allowed' to question their behaviour.
I apologise if I sound like I am 'ranting' but I too have learnt the hard way. HSBC were happy enough to take £200 a year for an overdraft facility, for my business, when I wasn't using it - yet within months of starting to use the facility (after 15 years of never going into overdraft) HSBC started to 'bounce' cheques and DD's even though I was trading within the agreed limits. Their 'reason' - they expect regular monthly deposits  - I ran a business on a self-employed basis and they were fully aware of this.
The 'Icing on the Cake' came in August, when they wrote to me saying that they were extending my overdraft facility for a further 12 months and they informed me that they had debited the account with £280.00 annual fee for this facility. At that time, I was £6k overdrawn, with a limit of £10k. Three WEEKS later, the HSBC bounced a DD, for £20 (O2 - mobile) and charged me £35.00 for the pleasure of doing it.
I am now bankrupt, but, strangely enough, it gives me no pleasure in knowing that HSBC will not get any of the £9k I owed them from 2 accounts (business and personal) when it would have been so easy for HSBC to have given a little bit of help which could have avoided my current situation.
The banks are no friends of the small businessman - they want to 'throw' money at you when you don't need it, but couldn't give a toss when you're in trouble.
I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
