    Are you saying the owner may have instructed MCA to act as landlord rather than as his agent?
    No, I'm saying that the owner may or may not have instructed MCA to act as his agent.

    If he did, then the owner is the LL. If he didn't, and knew nothing about the tenancy, then MCA was the LL.

    I thought the whole point in this scheme was to ensure tenants recover their deposits when they have done nothing wrong!
    Yes, and all this speculation could be pointless if you can simply claim the deposit via MyDeposits.
  • Update: mydeposits have said that as owner of MCA was
    wrongly !named as LL, the insurance taken out was invalid. Hence!I
    should contact Citizens' Advice Bureau.
    Before I do this though, I have the email address (not
    postal address)!for who I believe to be our LL. Should I email him and
    tell him the situation, and that he is now liable as the deposit was not
    protected?
