Car Finance PPI cover - Perrys Motor Sales Ltd

Hi guys,

I have just finished paying off my finance agreement on a car I Purchased in 2007 from Perrys Motor Sales Ltd.

Looking through the paperwork now, it would appear I have paid in excess of £800 worth of PPI cover although I didn't need it.

At the time of taking out the finance, I was in full time employment and no medical conditions.

Perrys cleverly created a special form for discussing PPI to see if it was 'suitable'. Although the salesman did not force me to take out PPI cover, he persisted in saying that it is highly recommended i took this out and pointed out all the cons of not having it i.e. scare mongering.

The questions on this form were basically on the lines of 'do you feel PPI would be beneficial to you in the event of unemployment/sickness' etc. Not do you feel you need PPI cover.

One question on the form reads:

Do you have any type of insurance that would specifically provide cover for the repayment of this agreement?

The answer was circled yes. However, thinking about it know i wouldnt have had this through my employer or insurer. So, the salesman had circled this as yes based on the fact that i would find PPI beneficial in the long term, not that i actually needed it.

I'm unsure as to wether i can claim anything back based on the circumstances. From what i make of it, Perrys must have known PPI wasn't needed and created a form to cover themselves in the event of a refund claim being made against them.

Can anyone help?

Many Thanks,

Shaun.

At the time of taking out the finance, I was in full time employment and no medical conditions.

Which is the perfect time to be taking it out and confirms you have no complaint reasons there.
Perrys cleverly created a special form for discussing PPI to see if it was 'suitable'.

You mean they completed a shortfall analysis to cover the demands and needs just as they should do?
Although the salesman did not force me to take out PPI cover, he persisted in saying that it is highly recommended i took this out and pointed out all the cons of not having it i.e. scare mongering.

So he correctly disturbed you with the consequences of being uninsured but let you know that you did not need to have it.

    Semantics.

Everything you have said suggests it wasnt mis-sold. Indeed, it actually highlights an example of the correct process. Because of the number of try-it-on complaints, they are totally correct to try and protect themselves. However, what they did are also requirements and failure to do these is one of the most common reasons why complaints elsewhere get upheld.

You appear to have no grounds for mis-sale.

  • Thanks for this. This is the reason why I posted my circumstances up on here, to see if i could claim or not, to avoid jamming up the claiming system for other people.

However, I'm struggling to see why that at the time of my taking out the finance, if i was employed and no medical conditions, how would this be the perfect time to take out PPI cover? Surely, it would be the other way round, if i was unemployed or had medical conditions then i would then need the PPI cover.

Sorry, i'm totally new to this sort of thing so please excuse me if i come across as a tw*t, i really dont mean to be.

Insurance covers you for the unknown. If you are unemployed then its too late to take insurance out. It only pays out when you are made redundant. Same with illness. You need to have it before the event occurs.

    You are doing fine.

The only issue is that what you see as covering their backsides and doing it wrong is actually them doing it by the rules and correctly. If they all had done it correctly like this, then there would be no mis-sales.

Thank you Dunstonh, I can now relax knowing that I haven't been ripped off.
